Terms of Service

Effective September 24, 2026

These terms are a contract between you and SCINTILLA MEDIA LLC, a Wyoming limited liability company ("we", "us"), about your use of Tavolista. By creating an account, starting the free trial or subscribing, you accept them. Please read section 17 carefully: it requires individual arbitration, waives class actions and jury trials, and explains how to opt out within 30 days.

1. Who can use Tavolista

Tavolista is a business service for restaurants, food trucks and other food businesses. You must be at least 18 years old and use Tavolista for your business, not for personal, family or household purposes. If you sign up for a business, you confirm that you are allowed to accept these terms for it; "you" then means you and that business.

Give us accurate account details, keep your password private and tell us right away at [email protected] if you think someone else used your account. You are responsible for what happens in your account.

2. What Tavolista does

Tavolista helps you turn your menu into social media posts. You can upload menus, specials and photos, create food images, headlines and captions in English and Spanish, review and approve drafts, schedule approved posts to the accounts you connect, and, on the Pro plan, reply to Google reviews. We improve Tavolista over time and may change or remove features. If we remove a core feature of your paid plan, you may cancel and we refund the unused part of a prepaid annual period.

3. Free trial

After you confirm your email address, you get one free 7-day trial per business. No payment card is needed, and the trial ends on its own without a charge; it never turns into a paid plan automatically. During the trial you can create up to 60 post images and use 5 menu uploads and 30 single-dish uploads. Connecting social accounts and publishing require a paid plan. We may end or refuse a trial that is used to get around these limits, for example through several accounts.

4. Paid plans, automatic renewal and cancellation

Plans are priced per restaurant location: Starter costs USD 59 per month or USD 590 per year, Pro costs USD 79 per month or USD 790 per year and adds Google review replies. Applicable sales tax is added where required and shown at checkout. Each additional location needs its own subscription.

Automatic renewal: when you subscribe, we charge the price shown at checkout right away. Your subscription then renews automatically at the end of each month or year, at the then-current price, and we charge your saved payment method for each new period until you cancel. You authorize these recurring charges. For annual plans we email you a reminder 15 to 30 days before each renewal.

Cancel online anytime in Billing, in the same place you subscribed. Cancellation takes effect at the end of the current paid period: you keep access until then and are not charged again.

Price changes: we will email you at least 30 days before a new price applies to your next renewal. If you don’t want to pay the new price, cancel before that renewal.

Payments are processed by Stripe. If a payment fails, we may retry it; scheduled posts pause until the payment succeeds, and we may end the subscription if it stays unpaid. To change plans, contact support.

Refunds: fees already paid are not refunded, except where this section says otherwise, where the law requires it, or for a billing error on our side that you report within 60 days. Please contact us before disputing a charge with your bank; we usually resolve billing questions quickly.

5. Plan limits and fair use

Each paid plan includes, per location and calendar month in your restaurant’s time zone: up to 30 scheduled publications, 60 post images, 5 menu uploads and 30 single-dish uploads. Unused amounts do not carry over. If a creation fails, the used allowance is restored. To keep Tavolista fast and reliable for everyone, we also apply reasonable daily limits and may slow down or pause activity that looks automated or abusive.

6. Your content

You keep all rights to the menus, photos, logos, text and other material you upload ("your content"). You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, adapt (for example resize a logo or combine it with an image), transmit and display your content only to provide and secure Tavolista for you and to carry out what you ask, such as publishing an approved post. This license ends when your content is deleted, except for copies in backups until they expire and copies we must keep by law.

You confirm that you have the rights needed for your content, including logos, trademarks, photos and the consent of any person shown, and that it does not break the law or anyone else’s rights.

7. AI-generated content

Tavolista uses artificial intelligence to read menus and create food images, headlines and captions ("outputs"). As between you and us, you own the outputs created for your business and may use them in your marketing; we transfer to you any rights we have in them. Please note that outputs created mainly by AI may not be protected by copyright, and similar outputs can be created for other users.

Food images are illustrations based on your menu, not photographs of your actual dishes, portions or premises. They and the text can contain mistakes or show details that differ from what you serve. Review every post before you approve it, and replace an image with your own photo whenever the food looks different. You are responsible for what you approve and publish, including prices, ingredients, allergen, dietary, health, alcohol and promotional statements, compliance with advertising and consumer protection laws, and any platform rule that requires you to label AI-generated or edited content.

We do not use your content or outputs to train AI models. We send the data needed for each task to AI service providers, who process it under their own terms (see our Privacy Policy).

8. Connected platforms

Instagram, Facebook, Google Business Profile and TikTok are run by Meta, Google and TikTok, not by us. When you connect an account, you authorize us and our publishing provider to act for that account as you direct: to publish the posts you approved, read your Google reviews and post the replies you approved. On TikTok, each post goes out as a short video made from the post you approved. It is marked as promoting your own business, carries TikTok’s AI-generated label when the food image was created by Tavolista, and may include a track from TikTok’s Commercial Music Library. By publishing to TikTok, you agree to TikTok’s Music Usage Confirmation. The platforms’ own terms and rules apply to you. We are not responsible for their availability, technical changes, moderation decisions, account restrictions or the reach of your posts, and we cannot guarantee that a platform accepts every post. Tavolista shows you whether a publication was confirmed. You can disconnect an account at any time.

9. Acceptable use

Do not use Tavolista to: publish unlawful, misleading, defamatory, hateful or infringing content; impersonate a business or person; send spam; advertise illegal goods or services; upload malware; add unnecessary sensitive personal information, such as health or financial data, to menus or posts; get around plan limits, security measures or trial rules; copy, scrape, reverse engineer or resell Tavolista, except where the law allows it; interfere with the service or other users; or break any law or platform rule.

10. Copyright complaints

If you believe content in Tavolista infringes your copyright, email [email protected] with: the work you claim is infringed; the material and where it appears; your name, address, phone number and email; a statement that you believe in good faith that the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We remove material when appropriate, forward counter-notices as the law provides and close the accounts of repeat infringers.

11. Privacy and security

Our Privacy Policy explains how we handle personal information. We use reasonable administrative, technical and physical safeguards to protect your data and will notify you of a security incident affecting it as the law requires. No system is completely secure, so keep your login details safe.

12. Suspension, termination and your data

You can stop using Tavolista at any time: cancel your subscriptions in Billing and ask support to delete your account. We may suspend or close your account if you seriously or repeatedly break these terms, do not pay, create a risk for Tavolista, other users or third parties, or if the law requires it. When reasonable, we warn you first and give you time to fix the problem. If we close your account without such a reason, we refund the unused part of any prepaid period.

After an account ends, you can ask us within 30 days for your content; after that we delete it. Backup copies expire on a rolling schedule within about 35 days, and we keep records we need for tax, accounting, security or legal reasons.

13. Changes to these terms

We may update these terms. For material changes, we email you at least 30 days before they take effect, unless a change is required by law or needed to address security or misuse, in which case it may apply sooner. The effective date at the top shows the current version. If you continue to use Tavolista after a change takes effect, the new terms apply; if you do not agree, cancel before that date. Changes do not apply to disputes that arose before them.

14. Disclaimers

Tavolista and all outputs are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that Tavolista will be uninterrupted or error-free, that outputs will be accurate, or that using it will bring you more guests, followers, reach or sales.

15. Limitation of liability

To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business, data or goodwill, even if advised of the possibility. Our total liability for all claims relating to Tavolista is limited to the greater of the amount you paid us for Tavolista in the 12 months before the event giving rise to the claim, or USD 100. These limits do not apply to your payment obligations, to your obligations under section 16, or to liability that cannot be limited by law.

16. Your responsibility for claims

You will defend and indemnify SCINTILLA MEDIA LLC and its members and contractors against third-party claims, damages and reasonable legal costs arising from your content, the posts and replies you approve or publish, or your breach of these terms, the law or a platform’s rules. We will tell you promptly about such a claim and let you control its defense, but you may not settle it in a way that admits fault for us without our consent.

17. Disputes and arbitration

Talk to us first: before starting a claim, email [email protected] with a description of the problem and what you ask for. We will both try in good faith to resolve it within 30 days.

If we cannot, any dispute relating to these terms or Tavolista will be resolved by final and binding arbitration, on an individual basis, administered by the American Arbitration Association under its Commercial Arbitration Rules (or its Consumer Arbitration Rules if those are found to apply). There is one arbitrator. The hearing may take place by video or on written submissions; any in-person hearing is held in Sheridan County, Wyoming. The Federal Arbitration Act governs this section. Either party may instead bring an individual claim in small claims court, and either party may ask a court to stop misuse of its intellectual property or of the service.

Claims may be brought only individually, not as a plaintiff or class member in a class, collective or representative proceeding, and you and we waive the right to a jury trial. If 25 or more similar arbitration demands are filed by or with the help of the same lawyers or organizations, they will be administered in batches of up to 50, with one arbitrator per batch.

You may opt out of this arbitration section within 30 days after you first accept these terms by emailing [email protected] with your name, your account email and a clear statement that you opt out. If you opt out, or if this section is found unenforceable for a dispute, that dispute will be decided only by the state or federal courts in Wyoming, and both parties agree to their jurisdiction; the class action and jury waivers above still apply to the extent the law allows. Any claim must be brought within one year after it arose, to the extent the law allows.

18. Governing law

These terms are governed by the laws of the State of Wyoming and applicable United States federal law, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

19. General terms

These terms, the Privacy Policy and the terms shown at checkout are the entire agreement between us about Tavolista. You agree to receive notices and agreements electronically; we send them to your account email, and you can reach us at [email protected] or by mail at our address below. You may not transfer your account without our consent; we may transfer these terms as part of a merger, acquisition or sale of assets. Neither party is responsible for delays caused by events beyond its reasonable control, such as outages of platforms or providers, natural disasters or government action. If a provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver. We are independent contractors. You confirm that you are not located in a country or on a list subject to US sanctions. If you send us feedback, we may use it without obligation to you. Sections 4 (unpaid amounts), 6, 7 and 12 to 19 survive the end of your account. If a translation differs from the English version, the English version applies.
